Contract Terms & Conditions
PLEASE READ CAREFULLY AND THOROUGHLY.
By booking your Personal Branding Photography, you agree to this agreement between you [Referred to as client], and Camille Percy Photography [Referred to as Photographer] This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to do so in writing, signed by all the Parties.
Payment The Client shall make a non-refundable retainer of 50% of the session to the Photographer to perform the services specified herein. Upon payment, Photographer will reserve the time and date agreed upon by both parties exclusively for you. Remaining balance is due 3 days before the session, if payment is not received The Client will forfeit the scheduled date and retainer fee. 12-Month Packages require 50% retainer to book, and the remaining balance due the date of the second session.
The Photographer will select the location where the photo session will take place. Most of session locations are outdoors, this allows for the best Natural Light photography as long as weather permits. Indoor locations with adequate natural light are also used. If the Client has a specific location in mind, please note that you are responsible for all location fees, studio fees, and permits.
If Client requests to amend or cancel this agreement 5 or more calendar days before session date, the payment shall be applied to a mutually agreed upon reschedule date. If Client cancels this agreement 4 or less calendar days before the session date or fails to show, the retainer paid shall be forfeited. Client understands and agrees that Photographer will not book other sessions during this time. In the event that Client cancels the session or fails to attend the session on the session date, the retainer paid shall be forfeited.
Client should arrive to session prepared (fully dressed, hair and makeup) and ready to shoot. If The Client is late arriving to the session, the amount of time late deducted from the allotted session time. Photographer reserves the right to leave if The Client arrives more than 10 minutes late for 30 minutes sessions, or 15 minutes for 1-hour sessions. No refund or reschedule will be given. In the event that the Client requests to reschedule a session, the payment will be applied to a rescheduled session if notice is given at least 5 days prior to the scheduled event. Reschedules must be within the same calendar year.If, in the opinion of the Photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting, Photographer may elect to use an alternate location or to reschedule session.
Copyright and Reproductions
The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions, and use, or for display within or on the Photographer’s website, social media pages or studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining written permission of The Client.
The Client shall only use the prints, including digital files, in accordance with the permissions within this agreement, speaking engagements, promotional and marketing use allowed. Print release & Commercial Release allowed.
The Photographer retains the right of discretion in editing the photographic materials released to the Client. Professionally edited photos will be delivered to Client digitally 5-7 days from session date. The Images provided by The Photographer may not be altered in any way. Photographer does not provide unedited photos to Clients. Failure to Perform If the Photographer is unable to perform this agreement due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, Photographer shall return the payment to the Client and shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, Photographer shall return the payment to the Client and shall have no further liability.
The Photographer shall be held harmless for any and all injury to Client during the course of the photography session and the immediately surrounding events. Attorney If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.
By booking your session you agree that you have read this contract, understand its terms, and agree to be bound thereby.
